Please read these Terms of Service ("Terms") carefully before using the website located at https://gloeproduct.com/ (the "Website") operated by GLOE PRODUCT, INC., a California corporation ("Company," "we," "us," or "our").
IMPORTANT: THESE TERMS CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING LIMITATIONS OF LIABILITY, A CLASS ACTION WAIVER, AND A FORUM SELECTION CLAUSE. PLEASE READ THESE TERMS CAREFULLY.

By accessing or using our Website, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Website. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Website. Your continued use of the Website after any changes constitutes your acceptance of the modified Terms.
2. ELIGIBILITY
By using this Website, you represent and warrant that you: (a) are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater; (b) have the legal capacity to enter into these Terms; (c) are not prohibited from accessing or using the Website under applicable law; and (d) will provide accurate, current, and complete information when making purchases.
3. PRODUCTS AND PRICING
3.1 Product Descriptions
We strive to accurately describe and display our products, including colors, sizing, and materials. However, we do not warrant that product descriptions, images, or other content on the Website are accurate, complete, reliable, current, or error-free. Colors may appear differently on different screens, and sizing may vary. If a product you receive does not match its description, your sole remedy is set forth in Section 6 (Returns and Refunds).
3.2 Pricing
All prices are displayed in U.S. Dollars and do not include applicable taxes, which will be calculated and added at checkout based on your shipping address. We reserve the right to change prices at any time without notice. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.
3.3 Product Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, and refuse or cancel orders at our sole discretion.
4. ORDERS AND PAYMENT
4.1 Order Acceptance
Your placement of an order constitutes an offer to purchase. All orders are subject to acceptance by us. We may refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud. If we cancel an order after payment has been processed, we will issue a full refund.

By providing payment information, you represent and warrant that you are authorized to use the payment method and that all information provided is accurate and complete. Payment processing is handled by Shopify Payments, and we are not responsible for the collection, use, or security of your payment information by Shopify or any other third-party payment processor.
4.3 Order Cancellation
You may cancel your order prior to shipment by contacting us at support@gloeproduct.com. Once an order has shipped, it cannot be cancelled, but you may return the item in accordance with Section 6 (Returns and Refunds). We reserve the right to cancel any order prior to shipment for any reason, including but not limited to product unavailability, pricing errors, or suspected fraud. If we cancel your order, you will receive a full refund.
5. SHIPPING AND DELIVERY
5.1 Shipping Locations
We ship to all 50 U.S. states and to the following international regions: European Union, United Kingdom, Canada, Mexico, and Australia. Shipping availability and rates may vary by location.
5.2 Shipping Costs and Timing
Shipping costs are calculated at checkout based on your shipping address and selected shipping method. Standard shipping within the United States typically takes 3-7 business days from the date of shipment. International shipping times may vary. We use USPS, UPS, and DHL as our shipping carriers.
5.3 Risk of Loss
Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. We are not responsible for items that are lost, stolen, or damaged during shipping. If your package is lost or damaged in transit, please contact the shipping carrier directly. For issues with delivery, you may also contact us at support@gloeproduct.com, and we will assist you in resolving the matter.
We offer optional shipping protection through Navidium at checkout. If you purchase shipping protection, claims for lost, stolen, or damaged packages may be filed directly with Navidium in accordance with their terms and conditions. Shipping protection is optional and is provided by a third party; we are not responsible for Navidium's processing of claims.
5.4 International Shipping
For international orders, you are responsible for all customs duties, import taxes, and fees imposed by your country. These charges are not included in the product price or shipping costs and are your sole responsibility. We are not responsible for delays caused by customs processing.
6. RETURNS AND REFUNDS
6.1 Return Policy
We accept returns within fourteen (14) days of delivery. To be eligible for a return, items must be:

6.2 Non-Returnable Items
The following items are final sale and cannot be returned:

6.3 Refund Options
Store Credit Only: For eligible returns, we issue store credit. We do not offer refunds to your original payment method for standard returns. Store credit will be issued within 5-10 business days of our receipt of the returned item and does not expire.
Exception for Fulfillment Errors and Manufacturing Defects: If we made a fulfillment error (e.g., shipped the wrong item) or if the item has a manufacturing defect (e.g., defective stitching, incorrect sizing due to manufacturing error), you may receive a full refund to your original payment method. See Section 6.6 for details.
6.4 Return Shipping
You are responsible for return shipping costs. We recommend using a trackable shipping method, as we cannot be responsible for items lost in return transit. Original shipping charges are non-refundable.
6.5 How to Initiate a Return
To initiate a return, please contact us at support@gloeproduct.com with your order number and reason for return. We will provide you with return instructions.
6.6 Defective or Damaged Items
If you receive a defective or damaged item, or if we made a fulfillment error, please contact us at support@gloeproduct.com within 7 days of delivery. We will provide a prepaid return label and issue a full refund to your original payment method. Due to limited inventory, we are unable to offer replacements.
6.7 Exchanges
We do not offer direct exchanges. If you would like a different size or color, please return your original item for store credit and place a new order.
7. USER ACCOUNTS
7.1 Account Creation
You may create an account on our Website to facilitate future purchases. Account creation is optional; you may also checkout as a guest. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate.
7.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
7.3 Account Termination
You may terminate your account at any time by emailing us at support@gloeproduct.com with the subject line "Account Termination Request" and providing your name and email address associated with the account. We will process your request within 30 days and confirm termination via email. We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.
8. USER CONTENT AND REVIEWS
8.1 Reviews and Comments
You may submit reviews, comments, and other content ("User Content") through our Website via Judge.me or other review platforms. By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, distribute, and display such User Content in connection with our business.
8.2 Content Standards
You agree that your User Content will not:

11. SMS MESSAGING
By opting in to receive SMS messages from us, you consent to receive recurring automated promotional and informational text messages at the mobile number you provide. Consent is not a condition of purchase.
Message Types: Promotional messages (sales, discounts, new arrivals), transactional messages (order confirmations, shipping updates), abandoned cart reminders, and back-in-stock notifications.
Frequency: Message frequency varies based on your interactions with us and marketing campaigns.
Costs: Message and data rates may apply. Check with your carrier for details.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the Uniform Commercial Code, or INCOTERMS.

Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
15.3 Class Action Waiver
YOU AND GLOE PRODUCT, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
16. THIRD-PARTY LINKS
The Website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such third-party websites or services.
17. WHOLESALE ACCOUNTS
We offer wholesale accounts for qualifying retailers and businesses. Wholesale accounts are subject to separate terms and conditions. If you are interested in wholesale purchasing, please submit an inquiry through our Website. Approval of wholesale accounts is at our sole discretion.
